The ATO may apply a failure to lodge (FTL) on time penalty if you have a lodgement obligation and do not lodge by the due date. The base penalty for individuals and small withholders is calculated as one penalty unit for every 28 days (or part thereof) the document is overdue, up to a maximum of 5 penalty units. The ATO also notes it generally doesn’t apply penalties in isolated cases of late lodgement and will often warn you first. Safe-harbour provisions may apply when you use a registered agent.

If an amount of tax remains unpaid after it should have been paid, the ATO may apply a general interest charge (GIC). The ATO explains that GIC can apply where a return is lodged late and that rates are updated quarterly.

3) Default assessments can occur if overdue obligations remain unresolved

Where lodgement obligations remain overdue and a cooperative approach is unsuccessful, the ATO can issue a default assessment (an assessment based on the ATO’s estimate). This can create additional stress and cost, and is one reason why acting early is usually the best approach.
